Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Puka podcast hosting platform and related services (the “Service”), operated by puka.studio [LEGAL FORM — TODO] (“Puka”, “we”, “us”). By creating an account or using the Service, you agree to these Terms.

1. Accounts and organizations

You must provide accurate information when creating an account and keep it up to date. You are responsible for activity under your account and for keeping your credentials secure. Organizations may invite additional members and assign roles; the organization owner is responsible for all activity within the organization.

2. Acceptable use

You agree not to use the Service to:

  • upload or distribute content you do not have the rights to publish;
  • infringe intellectual property, publicity, or privacy rights;
  • distribute unlawful, defamatory, or harmful content;
  • attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service;
  • send unsolicited communications or misuse the import or media features.

We may suspend or terminate accounts that violate these Terms or that create risk or legal exposure for Puka or other users.

3. Your content

You retain all ownership of the podcasts, audio, artwork, and other content you upload (“Your Content”). You grant Puka a worldwide, non-exclusive license to host, process, transcode, and distribute Your Content solely as needed to operate the Service — including generating RSS feeds, public show pages, and media delivery. You are responsible for ensuring Your Content complies with all applicable laws and third-party directory requirements.

4. Plans, billing, and trials

Paid plans are billed in advance on a recurring basis through our payment processor, Stripe. Fees are stated on our pricing page. Free trials, where offered, convert to a paid subscription unless a payment method is not added, in which case the trial is cancelled. You may change or cancel your plan at any time; cancellations take effect at the end of the current billing period. Except where required by law, payments are non-refundable. Abuse of trials or chargebacks may result in cancellation of your subscription.

5. Free tier and limits

The Service includes a free tier with usage limits. We may enforce plan limits (podcasts, uploads, members, imports) and apply grace periods for accounts that exceed them. We may change limits and pricing with reasonable notice.

6. Availability and changes

We work to keep the Service available and reliable but do not guarantee uninterrupted operation. We may modify, suspend, or discontinue features. If we discontinue the Service, we will provide a reasonable export window and, where feasible, a feed redirect so your listeners are not lost.

7. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms. On termination, Your Content may be deleted after a reasonable period; export your data beforehand.

8. Disclaimers and liability

The Service is provided “as is” without warranties of any kind to the extent permitted by law. To the maximum extent permitted by applicable law, Puka’s aggregate liability arising out of or relating to the Service is limited to the amounts you paid in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be limited under Austrian or EU law.

9. Governing law

These Terms are governed by the laws of Austria, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protections of your country of residence remain unaffected.
